Local Vape/Smoke Location & Operations Ordinances
More local governments are adopting ordinances to limit the number of vape /smoke shops popping up in their communities. The ordinances address where new shops can be located among some of the provisions.
As of May 2025, WV now has (4 )four cities (Huntington, Morgantown, Charleston, Hurricane) and (2) two county commission ordinances (Fayette & Putnam) that address vape and smoke shop locations and operations. Many more local governments are on the move!
Putnam County Commission is the first to pass an ordinance using their nuisance code section ( §7-1-3kk. Authority to provide for the elimination of hazards to public health and safety; penalty.) while 4 local governments have used zoning ordinances to address vape and tobacco shops in their jurisdiction.

Please refer to the Land Use Table under section 3-050 by looking up Vape/smoke Shop. There are also supplemental provisions in the land use table (no. 56) that which places spacing requirements from schools and other vape/smoke shops.
